Psychiatric Work Injuries

Under California Labor Code Section 3208.3, there are very high standards that have to be met before you can collect compensation from California workers comp insurance for a non-physical injury.

That's not to say that you cannot prove a psychiatric or psychological injury and disability, but it does mean a more extensive investigation and a longer process will likely be required before you can receive benefits.

If a violent act or accidental physical injury in the workplace led to the psychiatric damage, that will make it a little easier to prove your case. But you have to have worked at least 6 months for your employer before you can file a psychiatric workers comp claim, and there are other restrictions that apply as well.

At Orange County Workers Compensation Attorney, we have deep experience in proving psychiatric and stress-based workers comp claims. We know the ins and outs of the system here, and we can walk you through the process step by step.
